Terms and conditions of use

This page (together with the documents referred to on it) tells you the terms and conditions (the "Terms") on which you may make use of our website www.theskinny.co.uk (the "Website"), whether as a guest or a registered user. Please read the Terms carefully before you start to use the Website. By using or accessing the Website in any manner, you accept the Terms and agree to abide by them. If you do not agree to the Terms, please refrain from using the Website.

1.    Information about us

The Website is operated by Radge Media C.I.C. ("we" and "us").  We are registered in Scotland under company number SC310052 and have our main place of work and registered office at M9, Codebase, Argyle House, 3 Lady Lawson Street, Edinburgh, EH3 9DR.

2.    Accessing our site

2.1 Access to the Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on the Website at any time without notice. We will not be liable if for any reason the Website is unavailable at any time or for any period.

2.2 You are responsible for making all arrangements necessary for you to have access to the Website.  You are also responsible for ensuring that all persons who access the Website through your internet connection are aware of the Terms, and that they comply with them.

3.    Registration

3.1 There are areas of the Website where you can register to participate and/or view. The username and password and all other registration details used by you in connection with the Website are personal to you and you agree that you will not permit the use of such username, password or other registration details by any third party and you will not use the username, password or any other registration details of any third party. You are granted access to the registered areas of the Website subject to the following conditions:

3.1.1You will not share your registration details with any other individuals or third parties;

3.1.2You will not assist anyone who is not registered gaining access to registered areas of the Website;

3.1.3 You accept that we shall not be liable for the unauthorised use of your username and password including unauthorised transactions;

3.1.4 You accept that we have absolute discretion to suspend or terminate your registration and access to the Website whether in part or whole at any time and for any reason. If we terminate your registration your email address and password will become invalid on the Website immediately.

3.2 From time to time, we may restrict access to certain parts of the Website, or the entire Website, to users who have registered with us.

4.    Uploading Material to the Website

4.1 We do not control the content posted to the forums, comment threads, community noticeboards, discussion groups or any other user interactive areas of the Website, whether accessible to all users or only regsitered users (the "Community"). We reserve the right to delete, remove and/or edit messages and postings and terminate user access if we consider your use of or access to the Community to be inappropriate or damaging in any way. Our decision shall be final. By submitting content to the Community you agree to indemnify us and hold us harmless from any losses, including costs and expenses, arising out of your content.

4.2By using the Community areas you accept the following rules and will not:

4.2.1Post damaging viruses;

  4.2.2Post messages with recommendations to buy anything;

4.2.3Post messages that we consider to be abusive, defamatory, contain illegal content or are unlawful in any way;

4.2.4 Do anything detrimental to the Website; or

4.2.5 Post content that impersonates a person or entity other than yourself.

4.3Any material you upload to the Website will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such material for any purpose. We also have the right to disclose your identity to any third party who claims that any material posted or uploaded by you to the Website constitutes a violation of their intellectual property rights, or of their right to privacy.

5.    Intellectual property rights

5.1    We are the owner or licensee of all copyright and other intellectual property rights in the Website and all content of the Website.  Copyright laws and treaties around the world protect the Website and the contents of the Website.  All such rights are reserved.

5.2    You may retrieve and view the contents of the Website on a personal computer, print individual pages on paper and store that content in electronic format for your own personal, non-commercial use.

5.3    Except as set out above or as expressly agreed in writing with us you may not reproduce, modify or in any way exploit (whether commercially or otherwise) any of the contents of the Website.

5.4    If you print off, copy or download any part of the Website in breach of these terms of use, your right to use the Website will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

6.    General Disclaimer

6.1    Commentary and other materials posted on the Website are not intended to amount to advice on which reliance should be placed.  We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to the Website, or by anyone who may be informed of any of its contents.

6.2    While we endeavour to ensure that the material on the Website is correct and regularly updated we do not warrant the accuracy or completeness of the materials on the Website.  We may make changes to the material on the Website at ay time without notice.

7.1    The material displayed on the Website is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude:

    7.1.1    All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

    7.1.2    Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with the Website or in connection with the use, inability to use, or results of the use of the Website, any websites linked to it and any materials posted on it.

7.2    This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

8.    Information about you and your visits to our site

We process information about you in accordance with our privacy policy which you can view here.  By using the Website, you consent to such processing and you warrant that all data provided by you is accurate.

9.    Viruses, hacking and other offences

9.1    You must not misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Website, the server on which the Website is stored or any server, computer or database connected to the Website. You must not attack the Website via a denial-of-service attack or a distributed denial-of service attack.

9.2    By breaching this provision, you might commit a criminal offence under the Computer Misuse Act 1990. We may report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Website will cease immediately.

9.3    We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Website or to your downloading of any material posted on it, or on any website linked to it.

10.    Linking to the Website

10.1  You may link to our home page www.theskinny.co.uk provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

10.2    You must not establish a link from any website that is not owned by you.

10.3    Our site must not be framed on any other site, nor may you create a link to any part of the Website other than the home page. We reserve the right to withdraw linking permission without notice.

Where the Website contains links to other sites and resources provided by third parties, these links are provided for your information only.  We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

12.    Competition Terms and Conditions

12.1  By entering any competition and/or promotion operated by us contained on the Website ("Competition") you accept the following terms and conditions:

   12.1.1    Competitions are open to all members of the general public except (i) employees of Radge Media C.I.C., (ii) contributors to the Website and/or The Skinny Magazine and/or any other magazine produced by or on behalf of Radge Media C.I.C., and (iii) the families of such employees or contributors.

   12.1.2        Only one entry per person per Competition is allowed.

   12.1.3        Winners will be notified via email and will be required to respond within the time stated in the competition text.

   12.1.4        The editor’s decision is final.

   12.1.5    By entering a Competition you warrant that you have legal capacity to enter the Competition (i.e. that you are of sufficient age and mental capacity and are entitled to be legally bound in contract) and that you fulfil any other terms or conditions (e.g. age restrictions) of the Competition.  We reserve the right to request written proof of age of any winner.

   12.1.6    We reserve the right to disqualify any entrant if we have reasonable grounds to believe the entrant has breached any of these terms and conditions or other terms or conditions of the Competition.

   12.1.7    While reasonable endeavours will be made to supply the prize as specified, prizes supplied by third parties cannot be guaranteed.

   12.1.8    Entrants agree to take part in future publicity, however, we will not pass your details to third parties without your consent.

   12.1.9    We do not accept responsibility for the return of any Competition entries, including those consisting of artistic or other material.

   12.1.10    We cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the Competition or as a result of accepting any prize.

13.    Termination

Your right to use the Website may be terminated immediately by us if, in our reasonable opinion, you breach any of these Terms.

14.    Jurisdiction and applicable law

The Terms shall be governed by and construed in accordance with the law of Scotland and the Scottish Courts will have jurisdiction over any dispute arising from or related to these Terms.

15.    Trade marks

The Website does not grant you any licence or other right to use the trademark, "The Skinny", and any associated versions thereof, whether registered or unregistered, together with any device marks, designs or artwork.

16.    Variations

We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are binding on you.

17.    Severance

If any provision of these Terms (or any part of any provision) is found by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed not to form part of these Terms, and the validity and enforceability of the other provisions of the Terms shall not be affected.
